Securitisation
Liniya Prava has appeared to be the only Russian law firm with a 6+ year track-record of advising on mortgage lending and securitization deals, that has advised on all on-balance mortgage assets securitization deals in Russia. Liniya Prava’s lawyers have performed a proactive approach at every stage mortgage lending that has been taken in Russia – starting from contributing to establishing the relevant infrastructure in order to facilitate mortgage loans to the people and the process of going on with elaboration of the Russian mode of MBS, etc.
Within the practice Liniya Prava widely collaborates with the main market participants including the Agency for Housing Mortgage Lending and local Russian regulators such as the FFMS of Russia, Ministry of Economic Development of the RF and Ministry of Finance of the RF, as well as scientific and research organizations including the Center for Strategic Research and the Institute for Urban Economics.
Lawyers of Liniya Prava have significantly contributed to drafting the Federal Law ‘On Mortgage-Backed Securities’ and amendments thereto, ‘On Hypothec (pledge of immovable property)’,‘On State registration of rights to immovable property and transactions therewith’, amendments to the Tax Code of the Russian Federation, etc.
In 2009-2010 Liniya Prava elaborated a draft of ‘Standards for granting, servicing and refinancing mortgage loans with the help of the Agency for Housing Mortgage Lending, OJSC’.
